The Government is proposing a major overhaul of how the law treats the breakdown of all relationships.

The consultation will also address financial remedies on divorce.

It aims to bring consistency and fairness across marriage, civil partnerships and cohabitation, whilst ensuring that children remain at the centre of what happens when relationships break down.

The consultation will look at:

  • How to provide legal protection for co-habiting couples when their relationships end. This often leaves women and children financially vulnerable.
  • Whether pre-nuptial agreements can provide certainty and fairness for both parties.
  • How domestic abuse should be treated in financial discussions.
